Don't Toss CFL Bulbs August 24, 2008 If you've made the switch from incandescent light bulbs to the more energy-efficient compact fluorescent lightbulbs (CFLs), remember not to trash them when they burn out. Instead, recycle. Each CFL contains about five milligrams (about the size of the top on a ballpoint pen) of mercury, a neurotoxin that poses health and environmental concerns. While no mercury is released when bulbs are intact, mercury can leak out of incinerated or broken bulbs, contaminating water sources, air and soil. In some states, such as Maine and California, putting CFLs in the trash is illegal. Instead, bring your spent, unbroken CFLs to most Home Depot and Ikea retail stores to be recycled for free, even those you didn't buy from them. Ace Hardware also collects CFLs at select locations. Your state's household hazardous waste collection program also may recycle lightbulbs. For locations, visit the Environmental Protection Agency's lightbulb recycling site at epa.gov/bulbrecycling. The service is usually free, though some may charge a small fee. You also can mail them back but it isn't cheap. Lighting company Osram Sylvania sells prepaid, prelabeled recycling kits that hold up to 12 small (or 6 to 8 medium) CFLs for $15. Consumers can give the package to any letter carrier or U.S. Postal Service facility for return delivery.

The Big Mac Index is based on the theory of purchasing-power parity (PPP), which says that exchange rates should move to make the price of a basket of goods the same in each country. Our basket contains just a single item, a Big Mac hamburger, but one that is sold around the world. The exchange rate that leaves a Big Mac costing the same in dollars everywhere is our fair-value yardstick. Only a handful of currencies are close to their Big Mac PPP. Of the seven currencies that make up the Federal Reserve’s major-currency index, only one (the Australian dollar) is within 10% of its fair value. Most of the rest look expensive. Reverse 1031 Exchange FAQ sheet

Although the new IRS Revenue Procedure 2000-37 that provides “safe harbor” guidelines for reverse and improvement exchanges and has removed the tax risk associated with these types of exchanges, there are still many reasons why Exchangers may want to treat reverse

exchanges as a last and final option. Reverse exchanges require the Exchanger to place a significant level of trust in their accommodation company, and reverse exchanges, when done right, are not inexpensive. Additionally, it may not always be possible to structure a

reverse exchange with an accommodator who is willing or able to hold title. In addition, the properties to be held may be contaminated, or the down payment on the Replacement Property may not exceed the expected proceeds from the sale of the Relinquished Property.

In these circumstances it is important to know the options available to an Exchanger to avoid a reverse exchange. On the continuum of “least to most aggressive” the options are as follows. No withholding is necessary if transferee receives from transferor a properly completed Form N-289 stating (i) that transferor is not required to recognize gain or loss with respect to the transfer and (ii) briefly describing the transfer and summarizing the law and facts supporting transferor’s claim. Non-Hawaii residents doing 1031 exchanges of real estate may consider this option to avoid withholding. Please talk to a CPA to make sure, and do not rely on this without professional guidance.

How to change condo classification if your condo is no longer in the rental pool?
4. My Maui condo is not in the rental pool, Why is it classified as hotel/resort? (Maui County web site FAQ 12/09 at www co.maui.hi.us/FAQ.aspx?TID=97 ). The hotel/resort class means that “Units occupied by transient tenants for periods of less than six consecutive months…shall be classified as hotel resort” (MCC 3.48.305 C(4). If you are not in the rental pool or do not rent for six months or less, you should submit a Condominium Classification Declaration attesting to the actual use of your unit. This is a high quality Korean restaurant with a full sushi bar and upscale Korean barbeque cooked on your table`s built-in grill as well as a lot of Japanese cooked dishes and sushi/sashimi. One interesting dish is a variation of the classic Korean Bi Bim Bap which normally is a winter meat dish served hot in a stone crock. They have an uncooked summer variation here, with layered sashimi slices on a bed of rice flavored with a Korean vinaigrette. Food quality has been excellent on several visits. Excellent Chinese food off the menu but avoid lunch buffet. Very friendly family owns and runs the place, completely remodeled in 2006. Peking Duck fans: ask for Peking Duck with ``tortillas`` to avoid getting spongy bread pancakes for the duck.

German- Swiss restaurant - Brigit and Bernard`s Gardencafe 877-6000
Brigit & Bernard’s Garden Café (German-Swiss), Tel: 877-6000, 335 Ho'ohana St., Kaluhui, open lunch and dinner. Local lunch crowds clearly signal two things: consistently delicious food and visitors definitely should plan to have dinner at this tiny eatery “hidden” in the Kahului Industrial Area. Start with seared ahi or shrimp Dijon. For an entrée order Swiss chef/owner Bernard Weber’s rack of lamb, chicken marsala or a German specialty like jaegerschnitzel. (Turn off Dairy Rd. on Hukiliki, left on Hoohana). Hours may change, call 877-6000 to check, currently 10:30am-3pm Mon-Fri., 5-9pm Wed-Sat. Wailea: Matteo's Pasta, Pizza & Deli 100 Wailea Ike Dr. (near the Shops at Wailea) 874-1234. This new eatery has some of the best, and most inexpensive, Italian cuisine found anywhere on the Island. Their 10" "personal pizzas" (from $8.00) offer a clue here. We enjoyed a great spinach salad, and a small, but very tasty, meatball sub in addition to the aforementioned pizzas we tried on our second visit. Here you place your order at the counter, when you enter the restaurant, and your meal is served to you at both indoor and lanai tables. Hours as of 8/06: Mon through Sat, 11am-10pm. A California partnership is moving ahead with plans to develop a nearly 1,000-home subdivision in south-central Maui despite opposition from the County Department of Planning and some nearby residents. Ma'alaea Properties LLC recently filed a draft environmental impact statement for its estimated $400 million project called Ma'alaea Mauka proposed for 257 acres of former sugar-cane fields south of Wailuku.

The Special Management Area (SMA) pernit is part of a regulatory system that helps assure that permitted uses and activities that are defined as developments in the SMA are carried out in compliance with Hawaii's Coastal Zone Management Program. The SMA application provides a means to preserve, protect, and where possible,

restore the natural resources of the coastal zone of Hawaii by establishing special controls on development within the areas along the shoreline

so as to avoid the permanent loss of valuable resources and the foreclosure of land use and management options, and insure that adequate public access is provided to beaches, recreational area and natural reserves.

Time to Hit Pause -- Maui Planning Dept. 2-3-08
County officials said Maui must pursue careful and sustainable planning solutions for its limited amount of undeveloped land – most of which is currently designated as agricultural or conservation – as the island buttresses itself for an estimated increase from a population of about 140,000 today to 200,000-plus permanent residents and 70,000 part-time residents by 2030.

Federal and state energy officials are planning a major investment in new technologies in an attempt to make Hawaii the nation's first state to get the vast majority of its energy from renewable sources. If Hawaii and the Energy Department are successful in making the state mostly energy-independent in coming decades, it could serve as a model for the rest of the nation, which President Bush has described as "addicted to oil."

Waiakoa housing project moving before General Plan is completed
Maui County Planning Director Jeff Hunt said Thursday that he will not support A&B Properties' request to the state Land Use Commission to reclassify 94 acres in north Kihei to urban until the county completes its long-range planning. Hunt explained the county's position while A&B presented its plans for a 600-unit residential project to the Land Use Commission meeting at the Maui Prince Hotel. 8/22/08

The hotel was foreclosed on a week ago, and Prince Resorts Hawaii released a statement Monday saying it would end its management of the hotel Sept. 16 because it could not get funding assurances from the trustee for the lender. Barry Sullivan, attorney for the trustee, said Tuesday that two experienced hotel management companies with strong local connections are interested in taking over operation of the hotel. 9/2/09

When are High Wine Prices Justified?
Many (but certainly not all) expensive wines, such as the luxury brands from LVMH—which are advertised much like the group’s TAG Heuer watches, De Beers diamonds, Guerlain perfume, or Louis Vuitton handbags—are overpriced because such a large portion of their cost base is spent on marketing. This doesn’t just go for superpremium wines like LVMH’s Château d’Yquem, Krug, and Dom Pérignon; it also goes for brands like Cloudy Bay, a straightforward New Zealand Sauvignon Blanc whose price—without any apparent change in the production method—rose from about $15 per bottle to about $30 per bottle after LVMH acquired the brand in 2003 and began marketing Cloudy Bay as a luxury product. To me, when the consumer dollar is going more toward advertising than toward materials or production, it’s a paradigm case of overpricing. It bothers me that the mainstream wine media doesn’t take brands to task for this.

The Foreclosure Mess: It's Even Worse in 'Nonjudicial' States
In 23 states, before a lender can foreclose on a homeowner for defaulting on a mortgage, it must take the homeowner to court. As we've seen, even with judicial review that process has still been shot through with problems. But for a troubled homeowner in California, Texas and 25 other "nonjudicial" states, the robo-signing scandal and foreclosure mess are even more dangerous because the lender doesn't have to go to court to foreclose. Fraudulent paperwork can be used with impunity unless the homeowner is in bankruptcy, which is a judicial process, or unless the homeowner is represented in the foreclosure by an attorney who knows what to look for. 10/30/10

Focus Maui Nui brought together a diverse cross-section of nearly 1,700 residents to discuss their values and priorities. It begins with individuals who have a commitment to work toward an end goal in cooperation with state and county agencies whose lands are impacted by our endeavors. Hoaloha ‘Aina falls under the umbrella of Tri-Isle Resource Conservation and Development Council, Inc., a 501C (3) corporation for tax deductible contributions of materials and funds.
